Terms and Conditions

The following Terms and Conditions must be accepted by any individual or business entity wanting to register and use the Quantum Wallet System:

 

  1. Definitions
    1. "Service Provider" means Quantum Wallet (Pty) Ltd (registration number 2011/149060/07), a private company registered in South Africa.
    2. "System" or "Quantum Wallet System" means the prepaid electronic voucher system operated by the Service Provider.
    3. "Service" means the functionality provided by the System to the Member.
    4. "Member" means an individual who has registered on the Quantum Wallet System.
    5. "Account" or "Wallet" or "Member's Quantum Wallet" means the prepaid stock account associated with a Member registered on the Quantum Wallet System, utilized by the Member in order to effect transactions on the Quantum Wallet System.
    6. "Transaction" means any prepaid voucher purchase or wallet-to-wallet transfer transaction initiated by the Member on the System.
    7. "Terminal" means the Point-of-Sale device utilized by the Member to perform Transactions on the System.
    8. "Access Channel" means the Terminal which can be used to initiate a Transaction from the System.
    9. "PIN" means the personal identification number selected by the Member in respect of the Account.
    10. "Customer" means the individual to whom the Member sells a prepaid voucher.
    11. "Transaction ID" means a number generated by the System in respect of a specific Transaction in order to be utilized by the Member for enquiry and transactional purposes.
    12. "Helpdesk" means the helpdesk provided by the Service Provider for Member enquiries related to the Service.
    13. "Discount" means the discount on the retail sales price when purchasing a prepaid voucher. Information regarding discounts is provided on the rate card at http://info.quantumwallet.co.za/rate-card. The Discount is the effective Profit Margin for a Transaction, less any transaction costs.
    14. "Commission" means an amount credited to the Member's Account for transactions performed by other members that have been signed up by the Member. Information regarding commissions is provided on the rate card at http://info.quantumwallet.co.za/rate-card.
    15. "Levy" means any additional transaction cost(s) collected from the Member's Account for a Transaction. Information regarding transaction costs is provided at http://info.quantumwallet.co.za/costs.
  2. Use of the Quantum Wallet System subject to conditions
    1. The use of the System is provided subject to these terms and conditions.
    2.  The Service Provider may vary these terms and conditions by giving reasonable notice of such amendments to the Member, by posting a notification of amendment on the website https://www.quantumwallet.co.za.
    3. The purchase of Absa CashSend vouchers is subject to additional terms and conditions which are provided at http://info.quantumwallet.co.za/absa-cashsend.
  3. Crediting an Account
    1. The Member must deposit funds into the Service Provider's bank accounts in order to credit his/her Account. The preferred method of payment is by electronically funds transfer (EFT).
    2. The Account will only be credited once confirmation has been received from the Service Provider's bank that the funds have been received by the bank. The Member's Account will reflect a credit for the value of the amount deposited into the Service Provider's bank account.
    3. The Service Provider will recover the costs of the bank deposit fees from the Member's Account. The Member's Account will reflect a debit for the value of bank deposit fees. The bank deposit fees and other important information relating to bank deposits can be found at http://info.quantumwallet.co.za/costs.
    4. The Member shall use the Member ID allocated by the System on initial registration of the Account as the reference when making the deposit. Any other information provided in the deposit reference, or incorrect  information, will delay the processing of the deposit and crediting of the Member's Account. It is the responsibility of the Member to contact the Helpdesk if his/her deposit has not been processed.
    5. No cheques or credit cards will be accepted as payment.
  4. Operation of the Account
    1. The Member will, via the Access Channel, log into the System at https://www.quantumwallet.co.za with his/her PIN in order to instruct the System to execute a Transaction.
    2. For each Transaction, the Member's Account will reflect a debit for the value of the retail price of the voucher plus any additional levies, and will reflect a credit for the value of the Discount.
    3. If the Member purchases a prepaid voucher, the voucher will be displayed on the screen of the Terminal where such Terminal is a GSM cellphone (or other GSM mobile device) or personal computer; the voucher will otherwise be printed out on a paper slip where the Terminal is an approved POS device with built-in printer function. It is the Member's responsibility to retain the prepaid voucher in order to provide it to the Customer.
    4. The Member may request a reprint of a voucher for a previous Transaction from the System. The Member may either request a reprint of the most recent Transaction, or otherwise provide the Transaction ID of a previous Transaction.
    5. The Member must first request a reprint from the System for a prepaid electricity voucher if an error occurred during the execution of the Transaction before purchasing a another voucher for the same electricity meter number. The Service Provider will not be liable for duplicate transactions.
    6. The Member must confirm the name and/or address provided by the System after the initial prepaid electricity meter check with the Customer who provided the prepaid electricity meter number. The Service Provider accepts no liability if the Member proceeds with a Transaction for a prepaid electricity voucher where the name and/or address do not agree with the details provided by the Customer. The Service Provider cannot guarantee the reliability or accuracy of the name and/or address that is displayed by the System after the initial meter check.
    7. The Member may request the System to deliver the prepaid voucher to an email address and/or cellphone number via SMS, nominated by the Member. The Member will be charged for the cost of the SMS, which cost is provided at http://info.quantumwallet.co.za/costs. The delivery of the email and/or SMS containing the voucher cannot be guaranteed.
  5. Duties of the Member
    1. It is the responsibility of the Member to activate, configure and maintain the working condition of the Terminal. No claims can be made against the Service Provider for any losses due to the inoperability or loss of the Terminal.
    2. It is the responsibility of the Member to ensure that the Terminal has sufficient GSM airtime available to complete the Transaction if connectivity to/from the Terminal is provided by a GSM network.
    3. The Member must take all reasonable precautions to prevent unauthorised access to the Account.
    4. The Member must always conduct the business of selling prepaid vouchers in an honest way, and will act in the interest of the Customer.
    5. The Member will be the first line of support for any enquiries from the Customer.
    6. The Member must always inform the Customer of the value of the prepaid voucher they will receive for the Transaction, including all transaction costs charged to the Customer, before completing the Transaction.
    7. The Member may not charge any additional levies or transaction fees to a Customer for selling a prepaid electricity voucher, save for the cost of the optional SMS containing the voucher if this is requested by the Customer.
    8. The Member must retain the Transaction ID provided by the System in respect of any Transaction for enquiry and transactional purposes.
    9. The Member should make use of the various on-line reporting tools to monitor his/her Account for unauthorised sales activity.
  6. Helpdesk and customer support
    1. The Helpdesk can be contact by telephone at 012 844 0335 during business hours (08:00 - 17:00, Monday to Friday) or 079 256 8066 after hours (07:00 - 22:00, Monday to Sunday), or by email at helpdesk@quantumwallet.co.za, or by fax at 012 844 0331.

  7. Unauthorised use of the PIN
    1. If any unauthorised person obtains the PIN in any manner whatsoever, such a person will be regarded as the Member's duly authorised agent with full authority to use the System and access the Member's Account on the Member's behalf.
  8. Liability for loss or damage
    1. The Member acknowledges that the use of the System through the Access Channel is at the Member's own risk.
    2. The Service Provider will not be responsible for any damage, loss or consequential damage which the Member may suffer as a result of:
      1. any malfunction or defect in any hardware or software or action/non-action by any Internet or service provider used by the Member to access or in respect of the Access Channel;
      2. any system being off-line or unavailable in respect of the Access Channel;
      3. any other circumstances not reasonably within the control of the Service Provider;
      4. erroneous, unauthorized, incomplete, or unlawful instructions from the Member;
      5. unlawful or unauthorised access by another person(s).
    3. The Member indemnifies the Service Provider against any damage, loss and/or consequential damage that the Member may suffer as a result of incorrect, wrong, unauthorised and/or wrongful instructions or information given by the Member or any other person authorised or deemed to be authorised to act on behalf of the Member.
  9. Refund policy
    1. Once the system has issued the prepaid voucher to the Member, the voucher becomes the responsibility of the Member. Prepaid vouchers that have been used after the date of the Transaction cannot be refunded.
  10. Fees
    1. Any fees and charges in respect of the Transaction will be debited to the Member's Account.
    2. The Service Provider may vary the charges and fees in respect of the Transaction by giving reasonable notice of such amendments to the Member, by posting a notification of amendment on the web site.
  11. Termination or suspension
    1. The Service Provider reserves the right to terminate or suspend the Account of any Member not operating according to the terms and conditions herein.
  12. Confidentiality of information and security
    1. The Service Provider cannot be held responsible for the confidentiality of information contained in documents that are sent to the selected fax number or e-mail address, or cellphone numbers, or for information or documents that do not reach the selected fax number or e-mail address or cellphone numbers.
    2. The Member acknowledges that information transmitted through the Internet or any other communication system, including wireless communication system, and cellphones is susceptible to unlawful access, distortion and monitoring and that the Member uses the System at its own risk.
  13. Cession and delegation
    1. The Member may not cede or assign or otherwise make over or dispose of any of the Member's rights or obligations in terms of these terms and conditions without prior written consent of the Service Provider.
  14. No waiver
    1. If the Service Provider, for any reason or purpose, does not immediately enforce or implement any of the Service Provider's rights in terms of these terms and conditions, it does not mean that the Service Provider has abandoned or waived any of those rights.
